This file should not be speedy deleted as an obviously non-free file but which is not claimed by the uploader to be fair use, because... Wikipedia only considers U.S. copyrights. The result of the RfC was no consensus. You omitted the second sentence: What this means in practice is determined case by case, bearing in mind the goal of being able to freely distribute Wikipedia in the country an incorporated work originates from. (emphasis added). The image is free of copyright in most countries, since Iran is not a party to the Berne Convention. It's also a government work, so not significantly harming the rights of the author in a comparable way to a work by a private individual.
